The Suva Magistrate’s Court has issued a bench warrant for Isikeli Komaisavai, the former vice-president of the Social Democratic Liberal Party (SODELPA) in the Nasinu constituency, due to his failure to attend a scheduled hearing. Komaisavai, who is 52 years old, faces a charge of causing harm through electronic communication.
The allegations state that on February 10, 2021, in Suva, he made threatening comments on Facebook, suggesting harm to the then Attorney-General, Aiyaz Sayed-Khaiyum. During the court proceedings, police prosecutor Sharmila Lata informed Magistrate Jeremaia Savou that all witnesses were present, while Komaisavai was notably absent. As a result, the court approved a request to proceed with the trial in his absence.
Among those called to testify for the prosecution was Mr. Sayed-Khaiyum himself. The case has been postponed until December 17, when the court is expected to deliver a judgment.
This situation emphasizes the importance of accountability in public discourse, especially in the digital age where comments can have serious implications. It serves as a reminder of the responsibility individuals hold when expressing opinions and engaging in discussions online.
As the case progresses, it is essential to uphold the principles of justice and fair trial, providing an opportunity for all parties involved to present their sides. The upcoming judgment could potentially reinforce the legal boundaries surrounding online communication and the consequences of harmful rhetoric.
