Donald Trump expressed his frustrations on Monday regarding a gag order imposed on him, following his unsuccessful attempt to overturn a criminal conviction related to hush money payments made to adult film actress Stormy Daniels. This situation arose after the U.S. Supreme Court ruled in July that presidents may have immunity regarding their official acts, but this ruling did not apply to personal conduct.

Justice Juan Merchan rejected Trump’s motion to dismiss the New York state case, effectively blocking a path that could have enabled the Republican president-elect to assume office again without the burden of a criminal conviction. Trump’s legal team is now pursuing different arguments to overturn the verdict, particularly since he claimed victory over Democratic Vice President Kamala Harris in the recent election.

Legal expert Francisco Mundaca noted the significance of Merchan’s decision, suggesting that it indicates the conviction might stand despite the broader implications of presidential immunity. Trump took to his Truth Social platform to criticize Merchan’s ruling, labeling it an “illegal” and “psychotic” order and claiming it poses a threat to the presidency itself.

In May, a jury found Trump guilty of 34 counts of falsifying business records in connection with a $130,000 payment to Daniels.
