Trial Venue Dilemma: O’Connor’s Case Takes Center Stage

The Suva Magistrate Court has yet to determine the venue for the trial of former Assistant Health Minister, Alexander O’Connor. O’Connor appeared before Magistrate Pulekeria Low at the court yesterday, facing three counts regarding the misuse of state resources for campaigning.

The allegations state that on November 23, 2022, while in public office, O’Connor engaged in campaign activities and distributed FijiFirst candidate flyers at the Tukavesi Health Centre in Savusavu. During the proceedings, Fiji Independent Commission Against Corruption (FICAC) lawyer Rajiv Pathak informed the court that the Pre-Trial Conference (PTC) had been concluded and that a hearing date was needed.

As the case pertains to Savusavu, discussions arose concerning the trial venue. Pathak argued that the trial should take place in Savusavu, while defense attorney Matalita Koroibola requested that the PTCs be held in Suva when the matter was previously before Resident Magistrate Ms. Kiran. Magistrate Low clarified that only the Chief Magistrate has the authority to transfer the case files.

Both parties were instructed to file and serve the finalized Pre-Trial Conference minutes by the end of business yesterday. The case has been adjourned to October 17 for a mention to set a hearing date and establish the trial venue. O’Connor’s bail has been extended.
