Justice Daine Tuiqereqere of the High Court emphasized the importance of expert witnesses being well-informed before offering their testimony in the ongoing murder trial of Tevita Qaqa Kapawale. This remark followed the testimony of witness Savenaca Kadavi, whose substantial experience of 39 years was acknowledged, yet raised some concerns regarding the clarity of his insights.
During the proceedings, Justice Tuiqereqere addressed the defense, led by lawyer Tobia Ravuniwa, emphasizing the necessity for expert witnesses to have a comprehensive understanding of the case facts. In light of this, Ravuniwa announced plans to present two additional expert witnesses in the upcoming week—one being an engineer from Solanda Shipping and the other affiliated with the Fiji Maritime Academy.
Tevita Qaqa Kapawale faces severe charges, including five counts of murder, attempted murder, and criminal intimidation in connection with the deaths of Benjamin Mattaputty, Eme Warma, Alfat Kodri, Samuela Sukera, and Qiritavabea Cagilabakomeli, along with an attempted murder charge against Kaminieli Tucama and intimidation of Mitieli Cama. The trial has been adjourned until Wednesday at 9:30 am, with Kapawale currently in remand.
This case illustrates the legal system’s dedication to thorough examination and fairness, underscoring the complexities of serious criminal proceedings. The court’s careful handling of expert testimonies and the emphasis on due process serve to ensure justice is appropriately administered to both victims and defendants. The community’s keen interest in these proceedings further highlights the significance of transparency and accountability in the judicial process, fostering a hopeful environment for justice to prevail.
