Trial Date Set for Nawaikula’s Ongoing Parliamentary Dispute

A trial date has been established for the case involving former Social Democratic Liberal Party (SODELPA) member Niko Nawaikula. Nawaikula has filed a lawsuit against former Supervisor of Elections Mohammed Saneem and the Office of the Attorney-General, claiming they acted unlawfully and negligently by advising the former Speaker, Ratu Epeli Nailatikau, to remove him from Parliament.

This legal matter stems from his removal in August 2021 for using a name not listed on his birth certificate. His birth certificate identifies him as Nikolau Tuiqamea, while he was recognized in Parliament as Niko Nawaikula. The case was previously heard by Chief Justice Kamal Kumar, who found no issues with Nawaikula’s dismissal.

Following the dismissal of that case, Nawaikula pursued this lawsuit, alleging negligent and illegal advice concerning his removal. He appeared before Justice Usaia Ratuvili at the High Court in Suva with his new attorney, Sevuloni Valenitabua. During the hearing, Valenitabua informed the court that they had received the requested plea from the defense and were prepared to set a hearing date, indicating they would only call one witness.

After both sides confirmed there were no further issues, the court adjourned, scheduling the trial for April 28-30, 2025.
