Businesses currently lack accountability for ensuring the safety of their patrons and preventing violent incidents on their premises. However, Attorney-General Graham Leung has emphasized that under Section 72 of the existing law, nightclub owners cannot permit drunkenness or disorderly behavior within their establishments.
According to Mr. Leung, the Liquor (Amendment) Act 2023 has adjusted the hours for the sale and supply of alcohol, but existing provisions still provide mechanisms to prevent potential violence. The law mandates that a bar or nightclub licensee must not sell or supply alcohol to individuals who have already consumed a reasonable amount that they have yet to finish. Licensees who breach this regulation can face fines of up to $500. Furthermore, it is also illegal for establishments to supply liquor to anyone who is already intoxicated, and attempting to procure alcohol for someone inebriated is considered an offense as well.
The Attorney-General pointed out that there needs to be stricter enforcement of the current laws. He noted that although the basic legal framework is established for addressing alcohol abuse at night venues, the existing fines may be too lenient and suggested that the cabinet should consider increasing them to deter licensees from permitting intoxicated behavior on their premises.
In light of recent incidents, he indicated a potential review of the broader security industry, suggesting the creation of basic rules or standards for those working in this field. Mr. Leung plans to meet with members of the Central Liquor Board, who can offer insights and recommendations on improving current liquor laws.
This proactive approach by the Attorney-General reflects a commitment to enhancing public safety and responsible alcohol consumption practices in nightlife settings. By taking these measures, there is an opportunity to create a safer environment for patrons while encouraging businesses to uphold their responsibility.
In summary, the Attorney-General is advocating for stronger enforcement of existing laws and potential updates to the regulatory framework governing alcohol consumption in nightclubs, which could result in improved public safety in the community.
