A father of two, accused of raping his 33-year-old niece during a drinking session, has been granted a non-cash bail bond of $500. The married man, who is in his 50s, appeared in court before Justice Thushara Rajasinghe facing a rape charge.

The incident is alleged to have happened in June while the accused and the complainant were drinking at the man’s apartment in Tacirua. During the proceedings, state lawyer Katarina Dugan did not object to the bail, having completed the necessary surety checks. The defense lawyer, Shahlaa Begum, indicated that her client plans to reside in Nadi during the court proceedings.

The court has directed Ms. Dugan to provide a Domestic Violence Restraining Order to both parties by November 28. The prosecution plans to call three witnesses, including the complainant and the investigating officer, while the defense will only call the accused to testify. Justice Rajasinghe is scheduled to set a hearing date on April 11 of next year.

While incidents of such a nature are deeply distressing, the legal proceedings ahead will allow for a thorough examination of the case, ensuring that justice is served. It is crucial for the legal system to prioritize the well-being of all involved while providing a fair process. The upcoming hearings may bring clarity and potentially supportive outcomes for the victims of such crimes.

Summary: A man in his 50s has been granted bail after being accused of raping his niece during a drinking session. The court is set to hear the case further in April next year, with witnesses slated to testify.
