The Suva Magistrates Court heard this morning that the State’s seizure of licensing documents has brought operations of Elite Protection Security to a standstill. The company’s owner, Jone Vakarisi, along with three associates, are facing charges involving criminal trespass and the alleged illegal operation of a security firm.

During the court proceedings, the defence counsel highlighted the significant disruption to the business, explaining that due to the retention of the original licensing documents by the State as evidence, the company has been unable to function or apply for a new master licence from the Ministry of Defence. This situation has persisted for several months, contributing to the strain on the business.

The defence revealed that in October, a letter seeking reconciliation and reconsideration was submitted, but they claim the State has not responded in a timely manner. They argued that the original documents, once copied, should have been returned, characterizing the State’s refusal to release them as a primary issue for Elite Protection Security.

Despite acknowledging the detrimental effect on the company, the State maintains that the documents were seized lawfully and are necessary for the prosecution’s case, indicating that they will not release the originals at this point. The court noted the business impact but stated it lacked the authority to order the return of original evidence. Nevertheless, it encouraged the State to consider supplying copies to allow the business to resume limited operations.

The court has adjourned the case to January 28 and extended bail conditions. This situation highlights ongoing tensions between regulators and private enterprises, emphasizing the need for a balance between law enforcement and business continuity.
