Rule of Law in Focus: Uganda’s Chibita Speaks at Fiji Law Conference

Justice Mike Chibita of the Ugandan Supreme Court emphasized the fundamental importance of the rule of law during his address at the Fiji Law Society Convention held in Nadi. Highlighting that the essence of the rule of law is rooted in due process, he illustrated this with the example of a couple seeking a divorce, underlining that the law mandates a formal procedure including a hearing before a court can grant the divorce.

Reflecting on his experiences as a High Court judge, Justice Chibita noted, “Even in cases where I sentenced individuals to death, we adhered to due process.” He underscored that due process is essential in all judicial decisions and enforcements, regardless of the case’s nature, emphasizing that the integrity of the legal process is paramount.

Justice Chibita’s statements were made in response to inquiries during the session on “Identity and Sovereignty in a Changing Region,” where he reiterated that the rule of law is crucial for societal and economic stability. Drawing on his knowledge from Uganda, he argued that the effective implementation of legal principles directly influences the economy, reinforcing the significance of the justice system as a pillar of governance.

The discussions at the convention dovetailed with broader themes explored by other speakers, including the Fijian legal landscape’s challenges concerning the rule of law, governance, and constitutional design within multi-ethnic societies. Similar sentiments were echoed by Fiji Law Society President Wylie Clarke, who highlighted the struggles in upholding respect for the rule of law at the governmental level. Clarke’s remarks emphasized a growing concern about public trust in the legal framework and the necessity for reforms aimed at enhancing accountability and transparency.
