The Office of the Director of Public Prosecutions (ODPP) is currently assessing the Court of Appeal’s recent decision to overturn the conviction and sentence of Joshua Aziz Rahman, a Fiji-Canadian national. Rahman was previously charged with the unlawful possession of 39.5 kilograms of cocaine that was discovered in his father’s bedroom in Caubati in 2019 while his father was away.

Initially, Rahman was sentenced to 23 years in prison with a non-parole period of 14 years. Following his conviction, he lodged an appeal against both the verdict and the sentence. The Court of Appeal has now quashed the conviction but ordered that a retrial be conducted at the earliest opportunity.

The ODPP is deliberating on the situation and considering the possibility of appealing this latest ruling to the Supreme Court. This follows a pattern of careful legal scrutiny in similar cases involving drug-related offenses, highlighting the judicial process’s commitment to ensuring justice is served.
