A 16-year-old boy has been sentenced to a custodial term of 10 months and 20 days for the rape of his 13-year-old cousin in Tailevu, with the sentence suspended for three years starting from May 28, 2025. The court evaluated the case, which stemmed from an incident in October of the previous year.

Justice Pita Bulamainaivalu, who delivered the ruling, imposed several conditions aimed at aiding the juvenile’s rehabilitation. He is prohibited from viewing pornography in any form and must not be left alone in the presence of female or male children. The judge remarked that the juvenile is required to live with his parents, who are tasked with closely supervising him to ensure compliance with these court orders.

Furthermore, the juvenile must continue receiving counseling from the Social Welfare Department alongside his parents, reflecting a comprehensive approach to addressing his behavior. He is also mandated to remain enrolled in his agriculture vocational program, emphasizing the importance of education and constructive engagement in his rehabilitation process.

This case resonates with a concerning trend of familial sexual offenses, highlighting the judiciary’s commitment to not only punish offenders but also to focus on rehabilitating young offenders through structured support and supervision. In similar cases, courts have shown a preference for rehabilitation, recognizing that these young individuals often require guidance to prevent future offenses.

The emphasis on counseling and parental supervision in this ruling augurs a hopeful outlook for the juvenile, suggesting that with the right support, he may redirect his path towards becoming a responsible member of society.
