Prime Minister Sitiveni Rabuka is set to meet with the President today following discussions within the Cabinet about a recent High Court ruling concerning the dismissal of former FICAC Commissioner Barbara Malimali. This confirmation came from Minister for Information Lynda Tabuya after a Cabinet meeting held yesterday, where the Solicitor-General provided an update on the court’s decision and explored potential legal pathways for the Prime Minister.
The High Court has determined that the removal of Malimali was unlawful but refrained from reinstating her or awarding damages, leaving such decisions to the Judicial Services Commission. Tabuya emphasized the government’s respect for the ruling and reiterated the Prime Minister’s ability to consider an appeal if deemed necessary. She noted that the Prime Minister has a window of up to 41 days to make this decision.
The Cabinet reiterated its commitment to upholding the rule of law and maintaining the separation of powers, recognizing the independence of the Judicial Services Commission in handling this matter. The government has underscored its intention to adhere to legal processes as it awaits further decisions from the Commission before outlining subsequent actions.
This situation reflects the government’s dedication to navigating legal challenges judiciously and highlights the importance of transparency and accountability in public office. The ongoing process will be closely monitored as it unfolds, showing a commitment to lawful and ethical governance.
