Prime Minister Sitiveni Rabuka has announced that the government will file an appeal against the High Court’s ruling regarding the dismissal of former FICAC Commissioner Barbara Malimali. In a statement released this afternoon, he confirmed his decision to proceed with the appeal following the court’s determination.

Rabuka recognized the High Court’s decision to grant permission for a judicial review that questions the legitimacy of the Commission of Inquiry related to Malimali’s appointment. He indicated that the government would address this matter through the appropriate legal channels.

Despite the court’s ruling, Rabuka expressed encouragement, noting that the proceedings serve as a testament to the strength of democracy in Fiji. He emphasized the importance of maintaining the separation of powers and assured that there has been no interference by the Executive in judicial matters.

He reiterated the government’s commitment to upholding the rule of law and respecting the independence of state institutions, reinforcing that constitutional processes will be respected throughout this legal journey.
