The Fiji Court of Appeal is set to hear the bail application for former Police Commissioner Sitiveni Qiliho, who is currently serving a one-year prison sentence. He appeared in court alongside former Prime Minister Bainimarama, who received an early release last month. Both were convicted by the High Court in Suva on March 14.
During the hearing, their attorney Devanesh Sharma informed the court of their decision to withdraw a previously filed motion relating to their conviction and sentencing. This motion, which was submitted on April 23 last year, sought to stay their sentences in the Court of Appeal. However, the case proceeded regardless, and Sharma expressed confidence that Qiliho would soon be released, similar to Bainimarama.
Justice Chandana Prematilaka granted the applicants 21 days to submit their arguments regarding bail pending appeal. The State is required to respond to these submissions by January 21, and Sharma will have until January 28 to address the State’s response before the case is mentioned again on January 30.
This ongoing legal process reflects the complexities of the judicial system and the potential for shifts in legal outcomes. It shows that even in challenging circumstances, individuals have avenues for appeal and the support of legal counsel to navigate their cases. The court proceedings, while serious, also highlight the fairness and structure of the legal process in Fiji.
Overall, the situation underscores a judicial system that allows for due process, providing hope for those seeking justice and favorable outcomes.
