The Acting Director of Public Prosecutions, John Rabuku, has stated that the calls for his resignation by the Attorney General and the President of the Fiji Law Society are attempts to bypass the role of the Judicial Services Commission in resolving this matter.
Rabuku mentioned that the Commission is well aware of its responsibilities and has already discussed the way forward with him during two meetings held this week. He emphasized that there is a set process to be followed to ensure that the Office of the DPP continues to function efficiently under his leadership and that his departure is managed smoothly for the benefit of the staff and everyone involved.
When questioned about any communication from the Cabinet or the Commission regarding his resignation, Rabuku clarified that the Cabinet has no role in this matter and will not communicate with him about it. He confirmed that he has coordinated with the Commission on the timing and manner of his exit, a decision which the Commission will announce.
Rabuku pointed out that while the Supreme Court opinion is binding, whether he agrees with it or not is immaterial; the opinion must be followed. However, he stressed that the Supreme Court’s opinion is not an order for him to vacate his office immediately, underscoring the importance of waiting for the Commission to implement the prescribed processes.
He urged lawyers to thoroughly read and understand the Supreme Court opinion and highlighted the importance for senior lawyers to recognize their roles within the justice system.
