Chief Registrar Tomasi Bainivalu has expressed concerns regarding Francis Puleiwai’s attempt to address a complaint against FICAC Commissioner Barbara Malimali, warning her against undermining the integrity of his office. Mr. Bainivalu’s remarks followed Ms. Puleiwai’s submission of a complaint regarding Malimali’s issuance of a Stop Departure Order (SDO) against her.
In her complaint, Ms. Puleiwai contended that Malimali’s actions were unwarranted and violated the protocols outlined in the FICAC Act of 2007. She stated that the SDO was issued shortly after her departure for Brisbane, Australia, raising questions about its legitimacy due to an alleged lack of ongoing investigations into her actions at that time.
Mr. Bainivalu emphasized the need for respect towards the independent processes governing the acceptance of complaints, suggesting that Ms. Puleiwai’s inclusion of various political figures and media in her correspondence was inappropriate and could be seen as making a mockery of the complaint system. He assured that her complaint would be handled in the same respectful manner as others.
Meanwhile, Ms. Puleiwai defended her decision to involve these parties, arguing it was necessary for ensuring transparency and accountability in the handling of her complaint. She highlighted her belief in the importance of impartiality in the Legal Practitioners Unit’s dealings, requesting that her grievance be processed just like any other.
Ms. Puleiwai also pointed out that the active status of the SDO in the immigration system, despite alleged procedural errors, brings to light issues of favoritism and bias within the investigations related to her case.
This unfolding situation emphasizes the complexities within Fiji’s legal landscape and the various perceptions of authority and accountability. As discussions continue, it is vital for the involved parties to pursue transparency and uphold the rule of law, fostering a system that resonates with integrity and fairness for all involved.
In summary, the dispute highlights critical issues around accountability, the use of authority, and the processes involved within Fiji’s legal framework. It serves as a reminder of the necessity for transparent practices in governance that uphold the public’s trust. The hope remains that positive dialogue and resolution can emerge from this situation, reinforcing the importance of fairness and integrity in legal processes.
