Prime Minister Sitiveni Rabuka has voiced his intent to seek clarification from Justice Minister Siromi Turaga regarding the recent suspension of Fiji Corrections Service Commissioner Dr. Jalesi Nakarawa, an action that has attracted criticism and is viewed by some as a possible abuse of authority. Following Turaga’s announcement that Nakarawa was placed on leave due to alleged breaches and complaints within the corrections service, Rabuka confirmed that Nakarawa has since returned to his duties.

During a recent media interaction, Rabuka expressed concern that Turaga acted without consulting him prior to the suspension. Turaga had cited serious incidents warranting an investigation into the governance, conduct, and administration of the Fiji Corrections Service. The Prime Minister has refrained from commenting on potential double standards compared to previous incidents involving other officials, including former Minister for Women and Children Lynda Tabuya, but reiterated the need for a proper explanation from Turaga.

In light of the legal implications of this situation, former Attorney-General Aiyaz Sayed-Khaiyum criticized Turaga’s decision, declaring it legally flawed. He explained that, according to Section 130(4) of the Fijian Constitution, the authority to appoint and discipline the Commissioner lies with the President, not the Minister. He emphasized that any disciplinary action against a constitutionally appointed officer like Dr. Nakarawa should follow due process and be handled by the Constitutional Offices Commission (COC).

Opposition MP Ketan Lal expressed concern over the lack of transparency surrounding Dr. Nakarawa’s leave, warning that such actions could undermine public trust in governmental institutions. Both Sayed-Khaiyum and Lal have called for increased accountability and clarity from the government.
