The Nausori Magistrate’s Court has instructed the Police Prosecution to send the case of Sailosi Raikaci, a 24-year-old police constable and the son of Assistant Police Commissioner Sakeo Raikaci, to the Office of the Director of Public Prosecutions (ODPP). Raikaci faces one charge of theft related to the alleged theft of a minibus valued at $65,000 from the Nausori minibus stand.
During the initial hearing, Resident Magistrate Samanunu Vaniqi raised concerns about potential conflicts of interest given that ACP Raikaci is a superior to Police Prosecutor Sergeant Shelveen Sharma. After inquiries, Magistrate Vaniqi decided to transfer the case to the ODPP.
Sergeant Sharma, while having no objections to granting bail, recommended that strict conditions be imposed, which include the provision of one surety and surrendering of travel documents. Raikaci is also required to report to the Nausori Police Station twice a week, comply with a stop departure order, and refrain from contacting state witnesses.
Raikaci’s legal counsel, Isoa Matanitobua, proposed two sureties, but only one, his mother Naomi Raikaci, who is a principal lawyer, was accepted. The court disallowed the other proposed surety as the individual was merely an employee of the law firm.
Currently stationed at the Nabua Police Station, Raikaci will be required to report to the Nausori Police Station, which is registered as his official residence. The prosecution indicated that while the first phase of disclosures has been served, an additional 21 days will be needed to finalize the transcriptions for the defense. The case has been rescheduled to January 13, 2025.
This situation highlights the importance of transparency in the judicial process, especially considering the familial connections that could complicate proceedings. The court’s mindful approach in transferring the case demonstrates a commitment to fairness and the need to maintain public trust in law enforcement and justice systems. The upcoming months will be crucial for all parties involved as they navigate this case, aiming for an outcome that emphasizes accountability and the rule of law.
