In Honiara, Solomon Islands, Vanuatu’s Climate Change Minister Ralph Regenvanu emphasized the need for swift implementation of the International Court of Justice’s (ICJ) advisory opinion on climate change. Regenvanu is calling for the Pacific and global communities to convert the ICJ’s advisory opinion into tangible legal and policy reforms at all levels.
Regenvanu highlighted the importance of gaining UN General Assembly endorsement for the advisory opinion during International Law Week. This step is seen as crucial for turning the ICJ’s guidance into enforceable accountability measures. He urged nations, particularly within the Pacific, to integrate the opinion into their Nationally Determined Contributions (NDCs). This alignment is expected to be a focus at the pre-COP meetings.
The advisory opinion is seen as a pivotal tool in enhancing climate governance and ensuring the right to a clean and sustainable environment across the Pacific. A proposed Pacific Islands Legal Office aims to strengthen legal capabilities and establish binding climate standards. At the national level, efforts are underway to embed the right to a healthy environment into constitutional frameworks, as Vanuatu’s Council of Ministers has demonstrated.
Regenvanu also called for empowering communities to document climate-related harm, a step necessary for accessing reparations. The ICJ’s opinion provides the legal foundation to pursue accountability in areas such as finance, loss and damage, and protections for climate-displaced populations.
This development aligns with previous advocacy by Vanuatu and other Pacific leaders, who have been championing the ICJ ruling as a means to demand stronger international commitments and transparency from major polluting nations. The opinion not only strengthens advocacy efforts but also serves as a critical legal tool for securing climate justice and ensuring that global actions align with the need to address climate change’s adverse impacts on vulnerable communities.
