Nawaikula’s Appeal Hits a Snag: No Show in Court!

In a recent court session, neither Niko Nawaikula, a former member of the Fiji Parliament, nor representatives from the Attorney-General’s office were present for his appeal against a High Court decision. The case was reviewed by Justice Pita Bulamainaivalu in Suva, who acknowledged the absence of both the plaintiff and the defendants, leading to a ruling for an adjourned hearing.

Earlier this year, Nawaikula filed a constitutional redress application, arguing that a magistrate was assigned to transfer his case to the High Court under direction from the late former chief justice, Kamal Kumar, which he deemed unjust. However, his application was dismissed, resulting in a court order that required him to pay $2,000 to the Attorney-General’s office. The Fiji Independent Commission Against Corruption (FICAC) did not receive any costs due to the case’s circumstances.

Justice Bulamainaivalu classified Nawaikula’s appeal to the higher Court of Appeal as a valid alternative remedy, indicating that it was not appropriate to pursue constitutional redress in this instance. The case has now been postponed until November 29.

It’s worth noting that this situation illustrates the legal complexities that can arise in political matters, emphasizing the importance of due process and the need for all involved parties to actively participate in court proceedings. The upcoming hearing could potentially bring clarity to the case, offering an opportunity for resolution and the establishment of a more definitive legal precedent.
