In a recent development regarding former parliamentarian Niko Nawaikula’s legal proceedings, neither Nawaikula nor representatives from the Attorney-General’s office or the Fiji Independent Commission Against Corruption (FICAC) appeared in court. The case was heard by Justice Pita Bulamainaivalu at the Suva High Court, where the absence of all parties prompted the judge to issue a notice for an adjourned hearing.
Nawaikula, who previously served as a Member of Parliament for the Social Democratic Liberal Party (SODELPA), has been seeking constitutional redress related to a past decision by a magistrate, which he contends was improperly influenced by the former chief justice, Kamal Kumar. However, his earlier application for redress was rejected, and the court ordered him to pay $2000 to the Attorney-General’s office, while FICAC was not entitled to any costs in light of the case’s circumstances.
Justice Bulamainaivalu expressed that Nawaikula’s attempt to appeal this matter to the Court of Appeal provided sufficient alternative remedies, which rendered his constitutional redress claim an abuse of the court process. The next hearing is scheduled for November 29th.
