The High Court in Suva is set to reconvene today to discuss the ongoing legal matters related to Tevita Qaqa Kapawale, who faces multiple serious charges, including five counts of murder, an attempted murder charge, and a count of criminal intimidation.

Kapawale appeared in court alongside his attorney, Tobia Ravuniwa, before Justice Daine Tuiqereqere. The charges stem from an alleged incident on May 18, 2021, involving the deaths of five men aboard the FVO Tiro II in Fijian waters, along with an attempted murder against a Kaminieli Tucama and intimidation of a 49-year-old Mitieli Cama.

During the proceedings, Ravuniwa expressed concerns regarding the availability of case disclosures for his client, noting that they were unsure if these documents were still accessible at the Remand Centre or if they had been misplaced. He indicated a willingness to photocopy copies if it would ease the process for the State.

Ravuniwa also sought to challenge the caution interview previously conducted, but Justice Tuiqereqere clarified that the court would not revisit that ruling. State prosecutor Triveshni Sharma noted that this challenge would necessitate recalling all witnesses, which, she argued, would be impractical. She also pointed out that Kapawale had opportunities to seek Legal Aid representation in the past but chose to forgo that option.

Justice Tuiqereqere emphasized the importance of resolving all pretrial matters before his upcoming legal vacation.
