A concerning trend has emerged regarding the treatment of migrant workers, with a total of 147 documented cases over the past three years. This raises significant alarm about issues related to workplace compliance and treatment. The Ministry of Employment has successfully recovered $72,000 in unpaid wages for the affected workers, highlighting the ongoing challenges they face.
Minister for Employment Agni Deo Singh emphasized that the predominant grievances reported by migrant workers include non-payment of statutory entitlements, such as annual leave and sick leave, unpaid overtime, and violations of employment contracts. To tackle these issues head-on, a joint task force, in collaboration with the Department of Immigration, conducts regular inspections at worksites that employ migrant workers. These inspections specifically address concerns such as inadequate accommodation and repeated non-compliance by employers.
Singh pointed out that there are unauthorized deductions from wages, sometimes stemming from worker negligence, which constitutes a violation of the Employment Relations Act. Additionally, he noted that employers often fail to provide adequate living conditions for their employees.
Despite previous warnings and enforcement actions, some employers remain repeat offenders in breaching labor laws. Singh asserted that these employers are flagged to the Department of Immigration, warranting increased scrutiny during future applications to recruit overseas workers.
Loukinikini Lewaravu, the Director of the Fiji Human Rights and Anti-Discrimination Commission, highlighted a variety of issues faced by migrant workers, including the confiscation of identification documents, reduced wages, and instances of misinformation provided prior to their departure from their home countries. Many workers find that the promises made to them are not fulfilled upon their arrival, contributing to their vulnerability.
The call for greater awareness and stronger internal mechanisms in workplaces has grown louder, with advocates urging the need for migrant workers to better understand their rights and how to seek assistance when mistreated. The attention to these issues signifies a crucial step toward improving conditions for migrant workers and ensuring compliance with labor laws.
