A married man has been accused of raping a woman in her twenties during a massage session and is currently seeking bail, expressing concerns about being remanded with individuals infected with HIV. The accused appeared in the High Court in Suva on Tuesday, facing charges of sexual assault and rape related to an incident that allegedly occurred on November 1, 2023, when he was providing massage services to a work colleague at her home.

During the massage, the victim, who was suffering from back and stomach pain, reportedly felt uncomfortable as the accused began to touch her inappropriately. When she confronted him, he allegedly advised her not to worry, insisting that it was a matter between them. The situation escalated, and he is alleged to have forced her into non-consensual sexual intercourse, which she attempted to resist before fainting. After regaining her composure, the victim informed her boyfriend about the horrifying experience.

The accused has refuted the claims, stating that nothing untoward occurred between them. During the bail application hearing, his lawyer highlighted that the victim did not immediately disclose the incident to the medical professionals at the Lami Health Centre, only mentioning her stomach pain instead. However, the Director of Public Prosecutions (DPP) lawyer Unaisi Ratukalou countered this argument, noting the victim’s prior negative experiences with the healthcare system and police that may have impacted her willingness to report the assault.

The bail hearing is scheduled to continue on April 16, with a judgment on the case itself set for April 25. Given the complexity and gravity of the allegations, this case highlights the delicate balance the judicial system must maintain in addressing such serious accusations while ensuring all parties involved are afforded due process.
