Veronica and Manoa Malani, who faced a lawsuit for contempt of court brought by the Attorney-General’s Office in 2021, have been cleared of all allegations after the High Court in Suva dismissed their case. The couple expressed relief and joy as the verdict was announced on Tuesday after a lengthy legal battle spanning five years.
Justice Vishwa Dutt, who presided over the case, informed the couple that they are now “free” from the legal troubles that have burdened them since 2021. The couple was accused of contempt for comments made during a live Facebook video in which they allegedly criticized the judiciary and its members, actions that the A-G’s office claimed could undermine public confidence in the legal system.
Initially, the Attorney-General sought severe penalties, including prison time and significant financial costs amounting to $50,000 each for the couple. However, throughout the proceedings, the Malanis argued that no contempt of court was committed since there were no active proceedings when the comments were made. They maintained that any potential risk to the judiciary’s reputation was unintentional.
The A-G’s office filed an application to discontinue the case back in August 2023, marking a pivotal point in the protracted legal struggle. After a brief adjournment to sort out administrative matters, the High Court ultimately ruled in favor of the Malanis, dispelling the accusations against them.
Veronica Malani expressed gratitude towards their legal team, including former lawyer John Rabuku, and thanked God for providing her strength and hope as she continues to navigate other legal challenges.
This case not only highlights the importance of free speech but also brings to light issues surrounding the relationship between public commentary and the judiciary. As it stands, the dismissal reflects a commitment to ensuring justice is served without undue punitive measures against individuals speaking out. The couple’s victory can be seen as a hopeful sign for those who may be wary of the legal ramifications of engaging in public discourse.
Looking ahead, it is crucial for all parties in similar situations to understand the boundaries of free expression while maintaining respect for the judicial system. The outcome of this ruling may encourage more open discussions about transparency and accountability within the legal framework, promoting a healthier, more robust dialogue in society.
