Veronica and Manoa Malani have been acquitted of all allegations after a lengthy five-year legal battle concerning a contempt of court lawsuit initiated by the Attorney-General’s Office in 2021. The High Court in Suva dismissed the case, bringing relief and joy to the couple as the verdict was announced on Tuesday.
Justice Vishwa Dutt, who presided over the proceedings, confirmed that the Malanis are now “free” from the legal challenges that have enveloped them since 2021. They faced accusations of contempt for comments they made during a live Facebook video, where they criticized the judiciary and its members. The Attorney-General’s office argued that these remarks could erode public confidence in the legal system.
Initially, the Attorney-General sought severe repercussions, including potential prison sentences and significant fines of $50,000 each. However, the Malanis maintained their stance that no contempt occurred, as the comments were made when there were no active court proceedings. They asserted that any impact on the judiciary’s reputation was unintentional.
A significant development occurred in August 2023 when the Attorney-General’s office filed an application to discontinue the case, marking a turning point in the protracted legal saga. Following a brief adjournment to address administrative issues, the High Court ultimately ruled in favor of the couple, clearing them of any wrongdoing.
Veronica Malani expressed her heartfelt gratitude to their legal team and credited her faith for providing strength throughout this arduous journey. This case underscores the critical balance between free speech and the judiciary, highlighting the importance of protecting individual rights to express opinions without fear of undue punitive measures.
The dismissal of the Malanis’ case may encourage others to engage in public discourse while understanding the boundaries of free expression and respect for the judicial system. It reflects a commitment to fostering open discussions regarding transparency and accountability within the legal framework, which could promote a healthier dialogue in society.
