In a recent ruling, Resident Magistrate Semi Babitu declined a request from Zarin Khan’s legal team to lift a Stop Departure Order issued by the Fiji Independent Commission Against Corruption (FICAC). Khan, who is affiliated with Aliz Pacific, sought the removal of this order to facilitate overseas travel for medical reasons.

FICAC’s Principal State Counsel, Lilian Mausio, opposed the application, asserting that the court lacked jurisdiction over the issue and claiming that the applicant’s argument was misplaced. Mausio highlighted that Khan has not yet been formally charged, which means that the relevant section of the Criminal Procedure Act is not applicable in this case.

In his decision, Magistrate Babitu reiterated that the court could not intervene, as the Stop Departure Order was legitimately issued by the FICAC Commissioner under the authority granted by the FICAC Act.

This ruling emphasizes the importance of legal jurisdiction and procedural integrity within the framework of anti-corruption efforts. Despite Khan’s personal health needs, the decision underlines the necessity of adhering to legal protocols and the protective measures put in place to enforce accountability.

It is essential to recognize that while this situation may seem challenging for Khan, it also reflects a commitment to maintaining the rule of law, which ultimately serves the broader interests of justice in society.
