Tevita Qaqa Kapawale has been sentenced to life imprisonment by the Suva High Court for the May 2021 killings aboard the fishing vessel FV Tiro II, with a minimum term of 26 years and two months before he can apply for parole. Justice Dane Tuiqereqere described the offences as brutal, cruel and cold-blooded, and he found a high level of culpability in Kapawale’s actions.

Five crew members were killed in the attack: Benjamin Matitaputty, Eme Warma, Alfat Kodri, Samuela Sukera and Qiritavabea Cagilabakomeli, with their bodies never recovered. Kapawale also faced a charge of attempted murder against Kaminieli Tucama and criminal intimidation of Mitieli Cama; Tucama survived the assault, providing pivotal testimony in the case.

The judge noted the lasting impact on the victims’ families, who have endured prolonged grief and financial hardship, and he acknowledged that the two surviving crew members would have faced a terrifying experience as they fought to stay alive. The court found that Kapawale’s offending fell into an extremely high category, owing in part to planning or premeditation and the fact that none of the bodies could be retrieved, complicating closure for families.

In his ruling, Justice Tuiqereqere observed that Kapawale showed little to no remorse. The defendant had admitted to some involvement in the murders in other contexts but did not participate in the sentencing hearing, and he did not instruct a lawyer to speak on his behalf. Kapawale has 30 days to appeal to the Court of Appeal.

Security concerns outside the courtroom were raised by the Fijian Media Association (FMA), which condemned an attempted assault on journalists covering the sentencing as Kapawale was escorted from the High Court. The FMA stressed the essential role of media in maintaining transparency and accountability in the justice system and called for stronger security protocols around court proceedings, including during prisoner transport and court transitions. Stanley Simpson, FMA General Secretary, said the safety of journalists is non-negotiable.
