Former Police Commissioner Sitiveni Qiliho is currently embroiled in a significant legal matter, with his constitutional issue stemming from an abuse of office charge referred to the High Court for interpretation. This development occurred after the State raised no objections to the defense’s motion during proceedings before Magistrate Shageeth Somaratne in Suva.

Qiliho is facing charges alongside former Prime Minister Voreqe Bainimarama, with both implicated in allegations regarding the questionable termination of two police officers’ contracts in 2021. Bainimarama is specifically accused of exerting undue pressure on former Acting Commissioner of Police Rusiate Tudravu to fire Sergeant Penieli Ratei and Constable Tomasi Naulu, or resign himself if he refused to comply.

Qiliho stands accused of two counts of abuse of office for intervening in the disciplinary actions related to these officers, revising previous decisions that subjected them to minor penalties before leading to their dismissal. The High Court’s interpretation will clarify whether the commissioner of police is considered part of the public service under section 163 of the 2013 Constitution and thus eligible for charges under the Crimes Act.

A hearing on this matter is scheduled for mention on May 14, 2025, with public interest in the case continuing to grow.
