Lawyers Under Fire: 3915 Complaints Raise Concerns Over Legal Standards

The Legal Practitioners Unit has recorded a significant total of 3,915 complaints against lawyers since its establishment, as highlighted by Attorney-General Graham Leung during the 2024 Fiji Law Society annual convention held in Nadi. This number raises concerns about the quality and ethics of legal practice in the region, particularly regarding newly admitted lawyers who may not yet have fully developed their skills.

Leung pointed out that many young attorneys appear to be ill-prepared for the responsibilities that come with their roles. He stressed that the public tends to assume that all lawyers, simply because they hold a law degree, possess the same level of competency. However, he noted troubling disparities in communication skills, understanding of legal ethics, and general legal knowledge among some practitioners.

The Attorney-General echoed the sentiments of Acting Chief Justice Salesi Temo, who lamented the apparent lack of professional standards among emerging lawyers. The scope of complaints filed includes violations such as mishandling trust accounts, practicing without a valid certificate, conflicts of interest, non-refund of fees for unrendered services, overcharging clients, and even criminal conduct.

Of the total complaints reported, 1,910 have been resolved, while 2,005 are currently under review. This situation presents both challenges and opportunities for the legal profession in Fiji, highlighting an urgent need for better training and oversight for new lawyers.

Improvements in legal education and firm accountability could foster a more competent legal community. This could ultimately enhance public trust, ensuring that they receive the quality legal assistance they deserve. The effort to address these issues is a positive step toward strengthening the integrity and professionalism of the legal sector in Fiji.
