The High Court in Labasa has affirmed the conviction and sentence of New World Ltd, a significant supermarket chain, dismissing its appeal that challenged a ruling made in June 2023. The legal proceedings stem from an inspection conducted by the Fiji Competition and Commerce Commission (FCCC) in April 2019 at New World’s Naiyaca location in Labasa.

During the inspection, officials discovered that essential price information for 13kg and 4.5kg gas cylinders was not displayed prominently, as mandated. Consequently, the supermarket received a fixed penalty notice for failing to adhere to regulations regarding the display of maximum retail prices for price-controlled items.

Following a trial in March 2023, New World Ltd was found guilty of not displaying the authorised maximum retail price, resulting in a fine of $15,000 along with prosecution costs of $32.50. The supermarket subsequently filed an appeal against both the conviction and the imposed sentence.

In a ruling delivered by Justice Lee Burney, it was determined that the appeal lacked substantial grounds. Justice Burney noted that New World Ltd’s status as a repeat offender was a significant aggravating factor. “It is evident that the sentencing magistrate did not err in principle, and the fine of $15,000 cannot be viewed as excessively punitive,” he stated on February 5. He emphasized the importance of compliance with legal standards, particularly in challenging economic times, to protect consumers from dishonest practices.
