A father of two has been sentenced to eight years and ten months in prison after being convicted of raping his cousin. The sentencing took place at the High Court in Suva under the judgment of Justice Pita Bulamainaivalu, who also established a non-parole period of seven years for the perpetrator, a married man with a four-month-old baby and a nine-year-old daughter.
The crime occurred late at night between October 31 and November 1, 2021, in Nasinu, while the victim was under the influence of alcohol and had expressed her desire to sleep. Reports indicate that she was assaulted as she slept, and when she attempted to reach out for help, the defendant covered her mouth with a pillow. Following the incident, she confided in her grandmother, who subsequently reported the incident to Valelevu Police Station.
Justice Bulamainaivalu condemned the actions of the accused, labeling them as “atrocious and despicable.” The judge highlighted the betrayal of trust, noting that the complainant, who was rendered vulnerable in her uncle’s home, should have expected protection rather than harm. He emphasized the emotional toll on the victim, who is facing family rejection as a result of the assault, while the accused’s wife has voiced disbelief regarding the incident as indicated in the victim’s statement.
In addition to the prison sentence, a permanent domestic violence restraining order has been placed against the convict, ensuring that the victim is safeguarded from any further contact or intimidation.
