A man has been sentenced to 10 years in prison for the rape and sexual assault of a 21-year-old woman in Lami, according to a recent ruling by the High Court. The incident is noted as particularly disturbing, as the victim had sought assistance for a back massage at the man’s home, where she was staying due to transport-related hardships.

Justice Pita Bulamainaivalu, who presided over the case, emphasized the violation of trust inherent in the act, stating that the rape occurred in a place where the victim should have felt safe. The judge highlighted the serious emotional and psychological implications of such crimes, noting that the victim now lives in fear and has had to change her workplace and avoid places associated with the offender.

The court’s decision stipulated a concurrent prison term, which includes a non-parole period of nine years. Initially set at nine years, the sentence was adjusted to twelve years due to the severity of the crime, before being reduced for time already served and personal circumstances. The sexual assault charge added an additional three-year sentence, which has been ordered to run concurrently.

This case raises significant concerns regarding the rising incidence of sexual violence in Fiji, with the judge advocating for stricter penalties to deter such offenses and protect vulnerable individuals. Previous cases from the region have shown a similar pattern, reflecting a systemic issue where victims face long-lasting emotional wounds and challenges, including threats from perpetrators’ families.

The need for effective support systems for victims and a legal framework that rigorously holds offenders accountable is imperative. It is hoped that through such legal actions, communities can work towards creating a safer environment, fostering healing, and restoring trust among individuals. The message remains clear: society must not tolerate such acts, and justice must prevail for those affected.
