The Judicial Services Commission (JSC) operates independently under the 2013 Constitution, a point emphasized by Attorney-General Graham Leung, who stated that he has no power to intervene in its processes. This response came after Director of Public Prosecutions (DPP) Christopher Pryde raised concerns about his delayed return to work, despite being reinstated by the President. Pryde accused the JSC of inaction regarding a second set of complaints brought against him by Acting DPP Nancy Tikoisuva.

Leung clarified that the JSC cannot be directed by any entity, including his office, except through legal prescription or court order. He acknowledged receipt of Pryde’s communication regarding the issue but reiterated that the matter is solely within the purview of the JSC.

Pryde criticized the decision to allow Tikoisuva back into the office, calling her previous conduct harmful to the reputation of the Office of the DPP. He contended that his termination was due to a decision to not renew her probation and has expressed dissatisfaction with the lack of response from the JSC regarding his return and the new complaints.

The ongoing delay has drawn Pryde’s criticism, labeling it as unfair and detrimental to the public interest. Leung reinforced that the independence of both the JSC and the Office of the DPP must be upheld and respected.
