A U.S. District Judge has ruled that hundreds of Venezuelans deported from the United States to El Salvador must be granted the opportunity to challenge their detentions. The judge’s decision comes under an 18th-century wartime law and demands that the Trump administration facilitate the legal actions for the deportees within one week.

Judge James Boasberg highlighted in his ruling that the deportees were removed without proper notice or the ability to contest their deportations, emphasizing the gravity of such actions. He warned that if the government is allowed to carry on without affording these individuals the chance to challenge their deportations, it could set a dangerous precedent where people could be indefinitely transferred to foreign countries without any legal recourse.

This ruling follows the deportations that occurred in March when the Trump administration invoked the 1798 Alien Enemies Act to swiftly deport alleged members of the Tren de Aragua gang. Family members and lawyers of the deported Venezuelans contest the allegations, asserting that many of those affected are not connected to gang activities and were denied due process in the deportation process.
