The Judicial Services Commission (JSC) has made a pivotal decision following extensive discussions on the recent High Court ruling regarding the appointment and removal of the FICAC Commissioner. The commission has invited former FICAC Commissioner Barbara Malimali, her legal counsel, the Solicitor General, and the Prime Minister’s counsel to engage in dialogue on how to implement the court’s orders.

On Monday, the High Court emphasized that the authority to advise the President on matters concerning the FICAC Commissioner lies solely with the JSC, not the Prime Minister. This decision underscores the independence of the judicial process and the necessity for the JSC to operate within its legal boundaries.

The commission aims to expedite the resolution of the Malimali situation and has set a deadline to submit its recommendations to the President by March 31st. Acting Attorney-General Siromi Turaga will collaborate with the JSC in formulating these independent recommendations.

This swift action by the JSC reflects a commitment to adhere to the rule of law and reinforce judicial independence, assuring the public of a transparent process in dealing with significant judicial appointments.
