Inquiry Witnesses Show Honesty, Judge Reports

Justice David Ashton-Lewis has commended the integrity of witnesses who have thus far provided testimony in the ongoing Commission of Inquiry regarding the appointment of Barbara Malimali as Commissioner of the Fiji Independent Commission Against Corruption (FICAC). During a media briefing, he remarked, “Most times in courts, if it’s not criminal, people do their best. Very rarely do you find liars, but you do occasionally.” He emphasized that there has been no suspicion of dishonesty among witnesses at this stage, stating that cooperation has been commendable.

Justice Ashton-Lewis explained that some witnesses are participating virtually due to logistical challenges, particularly those unable to travel from New Zealand or Australia. He noted, “Our job is to get their evidence and to do what we can to assist,” allowing witnesses the choice to appear either in person or remotely.

Senior barrister Janet Mason addressed the need to revise the timeline for submitting the commission’s report, noting that the duration required for witness testimonies was not anticipated. She highlighted the importance of ensuring that individuals who might be affected by the inquiry have adequate opportunity to present their queries for a fair and thorough examination.

The commission is scheduled to hear from former President Ratu Wiliame Maivalili Katonivere in person. This inquiry is a significant effort aimed at scrutinizing the legality of Malimali’s appointment amidst ongoing investigations involving various political and public figures.

The ongoing proceedings underscore a collective commitment to transparency and accountability within Fiji’s governance structures, fostering optimism about restoring public trust in the nation’s institutions.
