Inquiry Under Fire: Justice Ashton-Lewis Stands Firm Amid Controversy

Justice David Ashton-Lewis has addressed public concerns following an interview with Australian radio station Radio 4CRB, emphasizing that there has been “no compromise” regarding the law or the findings of the Malimali Commission of Inquiry (COI) that he leads. The inquiry’s focus is on the appointment of Barbara Malimali as Commissioner of the Fiji Independent Commission Against Corruption (FICAC).

During the interview, Ashton-Lewis disclosed that he made 72 recommendations which include allowing the Director of Public Prosecutions to re-examine allegations noted in the report. He explained that if the Director finds sufficient evidence, indictments will follow.

In a related context, the Fiji Law Society has voiced concerns over Ashton-Lewis’s statements, suggesting they undermine judicial independence and could negatively affect public confidence in the inquiry. Some members of the society have called for his resignation, raising doubts about his adherence to the confidentiality required in his role.

The response from Ashton-Lewis stands in contrast to the criticism, as he maintains the integrity of the inquiry. Police Commissioner Rusiate Tudravu has indicated that authorities are still analyzing the COI report, and there has been no confirmation on whether those named in the report have been questioned or charged.

The inquiry represents a significant step toward enhancing accountability within Fiji’s governance, focusing on ethical standards in public service.
