Indigenous Rights Triumph: Court Decision Revives Tui Nadi Title Controversy

Justice has been served in a significant ruling concerning the Tui Nadi chiefly title, marking a notable moment in the ongoing struggle for indigenous rights in Fiji. Ratu Asiveni Dawai expressed his contentment two days after the High Court ruled in his favor against the iTaukei Lands Appeal Tribunal, which validated his claim to the Tui Nadi title after more than three decades of legal disputes.

The case traces back to 1994 when Ratu Asiveni’s father, Ratu Isireli Dawai, initiated the legal battle. On March 19, 2025, Justice Mohammed Mackie declared that the declaration of Ratu Vuniyani Navuniuci as the rightful Tui Nadi was irregular, invalid, and lacks any legal standing, supporting this assertion with criticism of prior rulings made by the iTaukei Lands Appeals Tribunal and the iTaukei Lands and Fisheries Commission, which were deemed made in bad faith.

Legal representative Isireli Fa brought to light failures in adherence to earlier court orders, noting that since 2007, there have been specific guidelines established to ensure fair inquiry processes concerning traditional titles, which have not been followed in this case. This has led to a broader discussion on the importance of experienced legal counsel in handling sensitive traditional matters within iTaukei institutions.

Ratu Asiveni emphasized that this ruling opens the door for healing and trust restoration within the Vanua and directs attention towards fortifying community relationships following years of turmoil. The iTaukei Land and Fisheries Commission will engage with the Vanua to outline future steps regarding the decision on the chiefly title, representing potential momentum towards reconciliation and justice.
