Historic Ruling Reshapes Leadership in Nadi Community

A member of the Yavusa Navatulevu community in Nadi has expressed gratitude following the High Court’s ruling that nullified the designation of Ratu Vuniyani Navuniuci as Tui Nadi. Kalaveti Vueti, who serves as a traditional guard to the Tui Nadi, described the court’s decision as a long-awaited and significant step for the community, marking the culmination of a 30-year struggle for recognition. “We are happy and grateful for the court decision that has been made,” Vueti stated, adding, “This has been ongoing for 30 years… We are thankful that Ratu Asiveni Dawai has been given the Tui Nadi position.”

The court’s decision was based on the judgment delivered by Justice Mohammed Mackie, which deemed previous declarations regarding Ratu Vuniyani’s title as irregular and void. This ruling is part of an extended legal narrative surrounding land rights and indigenous claims in Fiji. Notably, Justice Mackie criticized earlier rulings by the iTaukei Lands Appeals Tribunal and the iTaukei Lands and Fisheries Commission, which were ruled to be made in bad faith and contrary to sound legal principles.

In response to the ruling, Ratu Vuniyani expressed his disappointment over a social media statement issued by Ratu Asiveni’s legal team, which he felt disrespected the cultural significance and sacredness of the Vanua o Nadi. Ratu Vuniyani emphasized that while successes have been achieved, they have traditionally been kept private to honor their people and land.

Legal representative Isireli Fa clarified that their communication was intended solely to update community members about the outcome of the case. He stated that no disrespect was intended by publicizing the court’s decision.

The implications of this ruling extend beyond the individual cases, signaling a renewed recognition of indigenous rights and potentially setting a precedent for future disputes over ancestral land in Fiji.
