A landmark ruling has emerged in a case regarding the Tui Nadi chiefly title, marking a pivotal victory in the fight for indigenous rights in Fiji. Ratu Asiveni Dawai expressed his satisfaction following a High Court decision that upheld his claim to the Tui Nadi title, concluding over 30 years of legal disputes.
The origins of the case date back to 1994, initiated by Ratu Asiveni’s father, Ratu Isireli Dawai. On March 19, 2025, Justice Mohammed Mackie determined that the declaration of Ratu Vuniyani Navuniuci as the rightful Tui Nadi was flawed, declaring it invalid and lacking legal standing. The judge also critiqued previous decisions by the iTaukei Lands Appeals Tribunal and the iTaukei Lands and Fisheries Commission, suggesting these rulings were made in bad faith.
Isireli Fa, Ratu Asiveni’s legal representative, highlighted a breach of adherence to court orders, noting that since 2007, there have been mandated guidelines for fairly handling inquiries about traditional titles, which were not observed in this situation. This case sheds light on the need for qualified legal representation in navigating the complexities surrounding such traditional matters within iTaukei institutions.
Ratu Asiveni remarked that this ruling signifies a step towards healing and restoring trust in the community. He expressed hope that it would pave the way for improved relationships within the Vanua following years of conflict. The iTaukei Land and Fisheries Commission plans to collaborate with the Vanua to outline future actions related to the chiefly title, potentially fostering reconciliation efforts and justice.
