High-Stakes Trial: Fiji’s Governance Tested as Former Leaders Face Abuse of Power Charges

A legal case involving former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho is currently ongoing in the Magistrate’s Court, surrounding allegations of inappropriate demands and abuse of office concerning two police officers. The case addresses the definition of “civil service and public service,” which is pivotal to the charges against Qiliho.

Bainimarama faces accusations of making unwarranted demands between May 21 and August 18, 2021, during his tenure as Prime Minister. He is alleged to have pressured Rusiate Tudravu, the then Acting Commissioner of Police, to either terminate the contracts of Sergeant Penieli Ratei and Constable Tomasi Naulu or resign himself. The charges highlight the pressure exerted on Tudravu in a significant abuse of power.

In parallel, Qiliho is facing two counts of abuse of office for allegedly overstepping his role by intervening in Tudravu’s disciplinary actions regarding the same officers, effectively canceling previously agreed minor penalties and resulting in their employment termination.

The matter was brought before Magistrate Jeremaia Savou, where it was debated whether issues of constitutional interpretation over public service definitions should be addressed in the High Court. Defense attorney Devanesh Sharma expressed a desire to resolve this interpretation thoroughly in the High Court, while state lawyer Pooja Mishra asserted that the lower court could proceed with the case as previous decisions have already been made.

With a trial set for June 2 to July 11, 2025, the case has garnered substantial public interest, emphasizing the necessity for accountability and ethical governance in Fiji. Observers are hopeful that these proceedings will result in clearer legal standards for public officials, thereby reinforcing trust in governmental institutions.
