High Stakes: Judge Battle in Grievous Harm Case Raises Questions on Mental Health Evaluations

A 53-year-old man named Sireli Cama has requested for his case to be overseen by a different judge in the High Court in Suva as he faces serious charges of grievous harm. Cama is accused of injuring a victim following an ongoing harassment dispute that escalated on April 16 of the previous year when he allegedly used a knife to inflict injuries after being warned multiple times to refrain from bothering the victim.

His case was recently called before Justice Dane Tuiqereqere, who relayed to Cama that it is not within an accused person’s rights to choose their presiding judge. Cama also voiced his desire for a swift resolution, stating that he had been in remand for over a year. However, the state’s lawyer, Tevita Naimila, informed the court that a psychiatric evaluation is still pending, as the doctor responsible has requested an additional six months for a thorough review to gauge Cama’s mental fitness, permitting time for him to take his medication.

Cama asserts that he has been adhering to his medication regimen within the remand facility, expressing a wish to enter a plea. Despite this, Justice Tuiqereqere maintained that proceedings would only advance once the medical evaluation clears him. As of now, Cama remains in custody, and the next court date is scheduled for April 15, with Justice Waleen George set to preside.
