Laisani Tabuakuro, the Assistant Director of Public Prosecutions, has called for the serious charges against former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho to be heard in the High Court. She maintains that the allegations, which include abuses of office and unwarranted demands, warrant the involvement of a higher judiciary to ensure rigorous scrutiny and uphold accountability in public service. The case centers around accusations that Bainimarama pressured the then-Acting Police Commissioner Rusiate Tudravu between May and August 2021 to either terminate two police officers or resign himself if he failed to comply. Meanwhile, Qiliho is charged with unlawfully terminating the officers after overriding Tudravu’s disciplinary decisions.
During a hearing at the Suva Magistrate Court, Tabuakuro emphasized the potential ramifications of this case, noting that a ruling by the Magistrate Court could set a dangerous precedent for governance in Fiji. She argued that this case is not merely an issue of public employees’ conduct but a matter that touches on the integrity of the civil service itself.
On the defense side, lawyer Devanesh Sharma contested the necessity of transferring the case to the High Court, asserting that the Magistrate Court is equipped to handle the accusations and that the state’s request comes too close to the trial date. Sharma has also raised concerns regarding the escalating legal costs faced by both Bainimarama and Qiliho, who are currently unemployed.
The courtroom drama is set to continue as both parties await a ruling on the transfer application scheduled for next Monday at 2:30 PM. The trial is due to commence on June 2, 2025, with high public interest anticipated, as approximately 30 witnesses are expected to testify.
