The Suva High Court recently heard the appeal case involving former Attorney General Aiyaz Sayed-Khaiyum and former Supervisor of Elections Mohammed Saneem, as they challenged a previous ruling by Magistrate Yogesh Prasad on significant issues central to their charges. This appeal centers on claims of fundamental human rights abuses, the validity of the charges against them, and whether the Director of Public Prosecutions (DPP) had the authority to lay charges instead of the Fiji Independent Commission Against Corruption (FICAC).

Justice Thushara Rajasinghe presided over the case and noted that the consolidation of charges against the two is on hold until these key issues are resolved. Lawyers have been instructed to obtain transcripts of the proceedings and to submit their written arguments by February 28, with a ruling expected on March 21. Furthermore, a plea hearing scheduled for March 10 in the Magistrates Court may also be postponed pending the ruling.

In detail, Saneem faces charges of receiving a corrupt benefit exceeding $50,000 in tax relief while he served as Supervisor of Elections between June and July of 2022. Meanwhile, Sayed-Khaiyum is accused of abusing his office by approving the government’s payment of Saneem’s taxes without necessary approvals from the Constitutional Offices Commission and the President.
