Justice Dane Tuiqereqere of the High Court has announced that more time is required to render a decision in the complex case of Tevita Qaqa Kapawale, who is facing multiple serious charges, including five counts of murder, one count of attempted murder, and one count of criminal intimidation. Mr. Kapawale, a father of three, has been accused of killing five fellow crew members aboard the FV Tiro II during an incident in May 2021. The victims include three Indonesian nationals and two Fijian men.

The judgment, which was initially expected on May 22, has been postponed with the new date set for June 26. Justice Tuiqereqere cited the extensive evidence and numerous issues being considered in relation to the case as reasons for this delay. On the day of proceedings, both the prosecution, represented by lawyer Triveshni Sharma from the Office of the Director of Public Prosecutions, and the defense, led by Tobia Ravuniwa from the Legal Aid Commission, presented their respective arguments.

The charges against Mr. Kapawale stem from allegations that he committed these acts during a violent confrontation on the high seas. Furthermore, concerns have been raised regarding the complexities of the evidence, particularly as there are no bodies recovered, which presents unique legal challenges regarding presumption of death in criminal matters. This issue emphasizes the discrepancy between criminal and civil law standards, which has been noted in previous hearings.

Despite the serious nature of the allegations, there is community interest in ensuring a fair legal process.
