High Court to Revisit Controversial Murder Case Disclosures

The High Court in Suva is set to reconvene today to evaluate Tevita Qaqa Kapawale’s request for additional disclosures from the State. Kapawale faces serious charges, including five counts of murder, one count of attempted murder, and one count of criminal intimidation. During the hearing, he appeared alongside his lawyer, Tobia Ravuniwa.

The charges stem from an incident on May 18, 2021, when Kapawale allegedly murdered five individuals aboard the vessel FVO Tiro II in Fiji’s waters and attempted to kill Kaminieli Tucama while intimidating Mitieli Cama, 49. Ravuniwa expressed concerns about whether Kapawale still had access to his disclosures at the Remand Centre or if they had been misplaced. He proposed that they could photocopy the necessary documents if it presented a challenge for the State.

Mr. Ravuniwa also sought to contest the voire dire ruling related to the admissibility of Kapawale’s caution interview. However, Justice Daine Tuiqereqere clarified that the court would not revisit that ruling, as it had already been addressed. State prosecutor Triveshni Sharma highlighted the practical difficulties of challenging the ruling, stating it would necessitate resummoning all witnesses, which is unfeasible. She also noted that Kapawale had the opportunity to engage Legal Aid services but chose not to.

Justice Tuiqereqere emphasized the importance of resolving all pretrial issues before he takes a planned legal vacation, indicating a commitment to ensuring that justice is served efficiently.

This case highlights the complexities often involved in legal proceedings, where the need for thoroughness must be balanced with the urgency of ensuring timely justice.
