High Court to Hear Controversial Strike Out Application in Landmark Case

The High Court in Suva has scheduled a hearing for the strike-out application filed by Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to Veronica Malani’s compensation claims totaling $800,244 against 11 individuals involved in the investigation of an alleged bombing case from 1987.

During the proceedings on Wednesday, all legal representatives were present before Justice Usaia Ratuvili. Sharma’s attorney, Ronal Singh, announced their readiness for a hearing date, but Malani was granted additional time to ensure her lawyer, Sitiveni Raikanikoda, could attend. Consequently, Justice Ratuvili set the hearing date for December 11, urging all parties to submit their documents prior to this date.

Raikanikoda raised concerns regarding the defense’s adherence to the proper civil procedures, noting that none of the defense attorneys had filed a statement of defense after receiving the writ of summons. Instead, they proceeded directly to submit a strike-out application. He also questioned the representation of former acting Police Commissioner Rusiate Tudravu and retired assistant Police Commissioner Biu Matavou, who are the fifth and sixth defendants. Raikanikoda pointed out that, as retired government employees, they should have their own legal representation and file their own submissions since they are included in the lawsuit. However, Justice Ratuvili stated that the trial would proceed regardless of their appearance.
