High Court to Hear Controversial Compensation Claims in December

The High Court in Suva has scheduled a hearing for the strikeout application filed by former Director of Public Prosecutions, Neelraj Sharma. This application is connected to a significant compensation claim of $800,244 made by Veronica Malani against 11 individuals involved in the investigation of an alleged bombing case from 1987.

During the court session on Wednesday, all attorneys were present before Justice Usaia Ratuvili. Sharma’s lawyer, Ronal Singh, indicated that they were prepared to proceed with a hearing date; however, Malani was granted additional time to ensure her lawyer, Sitiveni Raikanikoda, could attend.

Justice Ratuvili has set the hearing for December 11, during which all parties are expected to submit their arguments. Raikanikoda raised concerns about the defense not adhering to proper civil procedures; specifically, he noted that the defense attorneys did not file statements of defense in response to the writ of summons but instead opted directly for a strikeout application.

Additionally, he questioned the representation of former acting Police Commissioner Rusiate Tudravu and retired Assistant Police Commissioner Biu Matavou, who are the fifth and sixth defendants. He argued that since they are retired government officials, they should also secure legal representation and file submissions due to their inclusion in the lawsuit. Justice Ratuvili responded that the trial would proceed regardless of their appearance.

This legal development highlights the complexities within compensation claims stemming from historical cases, demonstrating the judicial system’s careful handling of such matters. With a hearing on the horizon, there is hope that clarity and resolution can be achieved for all parties involved.
