High Court to Decide on Major Compensation Claims in 1987 Bombing Case

The High Court in Suva has scheduled a hearing for the strike out application filed by Neelraj Sharma, the former Director of Public Prosecutions. This application pertains to an $800,244 compensation claim by Veronica Malani against eleven individuals linked to the investigation of a bombing case from 1987.

During a court session on Wednesday, all attorneys were present before Justice Usaia Ratuvili. Sharma’s lawyer, Ronal Singh, communicated the readiness to set a hearing date. However, the court granted Malani additional time to ensure that her lawyer, Sitiveni Raikanikoda, could attend.

Justice Ratuvili has arranged the hearing for December 11, when all parties are expected to submit their arguments beforehand. Raikanikoda raised concerns regarding the defense’s adherence to civil procedure, noting that none of the defense attorneys had filed a statement of defense after receiving the writ of summons, opting instead to file for a strike out directly.

He also questioned the representation of former acting Police Commissioner Rusiate Tudravu and retired Assistant Police Commissioner Biu Matavou, who are defendants in the case. Although they are retired government employees, they were represented by the Office of the Attorney-General. Raikanikoda inquired whether they should have independent legal representation and file their own submissions, given their inclusion in the lawsuit. Justice Ratuvili responded that the trial would proceed regardless of their attendance.

This ongoing legal matter underscores the complexities of litigation involving historical events and raises questions about procedural adherence by legal representatives. With a date now set for the hearing, all parties have the opportunity to clarify their positions, which could lead to a more transparent judicial process. It is a hopeful reminder that the justice system, while sometimes slow, continues to address concerns and disputes in the pursuit of resolution.
